WASHINGTON -- Today, the Internal Revenue Service announced a series of changes to assist struggling taxpayers affected by COVID-19 in settling their tax debts with IRS.
If the taxpayer believes they are eligible, he/she will complete a financial report using the form provided by Internal Revenue Service. Wage earners and self-employed individuals can use Form 433A. For offers that involve all types of businesses, Form 433B can be used. These financial statements include all assets and liabilities, as well as disposable income.
Those who still have the right to claim the credit may want to review the history of the credit since it was enacted by CARES Act. The Employee Retention Credit – 2020 vs. 2030 Comparison Chart shows the eligibility requirements. This chart was updated by the Relief Act of 2000 and then the American Rescue Plan Act of 2010.
A taxpayer who files an Offer that is based on a theory in doubt as liability (or TDL) must prove they have not had the opportunity of disputing a tax obligation. Taxpayers who can prove that they did NOT receive the correct notices about assessments or that the tax was not disputed during an audit will not be granted relief from the IRS. A solely based on doubt about liability, an Offer in Compromise is not subject financial information.

If you make an offer that is substantially the same as your previous offer, but within the last month, you do not need to file another Form 656, so long it is not significantly different. Instead, simply write a brief note. A note can be written to let the recipient know that you are interested in changing your offer.
